Secured lending

Banks and financial institutions often require lending to be secured against assets (security) such as real estate property or plant and machinery. In these circumstances, it is normal for the security to be valued to ensure it provides sufficient protection to the lender in the event of a default on repayment of the loan. Woolley & Wallis is an approved valuer for many of the mainstream lenders meaning we are able to carry out most secured lending valuations. Time is often crucial with secured lending valuations and so we aim to finalise our valuations promptly and report direct to the lender.

Planning & development control

Planning permission is normally required for the ‘development’ of land or buildings or the making of a material change in their use. Development is defined by the Town & Country Planning Act 1990 as ‘the carrying out of building, engineering, mining or other operations in, on, over or under land, or the making of any material change in the use of any buildings or other land'.

For certain forms or classes of development, planning permission is either not required or can be obtained by serving the appropriate notice on the Local Planning Authority (Prior Notification). These forms of development are known as ‘Permitted Development' and are set out by the Town and Country Planning (General Permitted Development) Order 1995 (as amended).

The issue of dilapidations is quite often overlooked and underestimated by tenants. It relates to elements of disrepair for which the tenant is responsible that have accrued during the lease term.

In practice, the procedure is instigated through the service of a Schedule of Dilapidations upon the tenant, towards the end of the lease. The schedule’s content will include the work a tenant needs to undertake to raise the condition of the property in accordance with the lease covenants. This works will cover repair, redecoration, reinstatement and statutory compliance, with the intention of leaving the premises in a condition suitable for re-letting.
