Farm & Rural Services

Professional valuations may be required for a range of purposes and our Farm & Rural department specialises in the valuation of rural assets including property, crops, livestock and machinery.

All our valuations are carried out by RICS Registered Valuers, many of whom are also Fellows of the Central Association of Agricultural Valuers (CAAV). These professional bodies ensure that members possess the necessary skills, knowledge and experience to carry out valuations competently and to a consistent high standard.

Woolley & Wallis’ valuations are also ISO9001 accredited giving additional peace of mind to users of our reports.

For more information on the most common types of valuation, please click on the relevant links below:

Secured lending

Banks and financial institutions often require lending to be secured against assets (security) such as real estate property or plant and machinery. In these circumstances, it is normal for the security to be valued to ensure it provides sufficient protection to the lender in the event of a default on repayment of the loan. Woolley & Wallis is an approved valuer for many of the mainstream lenders meaning we are able to carry out most secured lending valuations. Time is often crucial with secured lending valuations and so we aim to finalise our valuations promptly and report direct to the lender.

Taxation

The majority of capital taxes require an assessment of value to be made and so it is important that a credible and accurate valuation is obtained.

Woolley & Wallis regularly carry out valuations to underpin the assessment of a wide range of taxes to include:

  • Capital Gains Tax
  • Inheritance Tax (probate)
  • Stamp Duty Land Tax
  • Business Rates
  • Council Tax
  • Income Tax
  • Corporation Tax

We work closely with a number of accountants and financial advisors to ensure our valuations are fit for purpose and that we are always alert to opportunities to mitigate the potential tax liability.

Sales & acquisitions

The acquisition and sale of assets often requires a professional valuation, particularly in circumstances where the transaction needs to be justified to a third party.

These valuations are usually required by:

  • Charities
  • Trustees
  • Pension funds

A professional valuation may also be required where the seller or buyer requires independent advice that the proposed transaction value is appropriate in the prevailing market conditions.

Dispute resolution and compensation

Financial statements

Professional valuations of property and assets are often required for inclusion within financial statements. This is most commonly required in connection with:

  • Periodic valuation of investment property held by companies
  • Annual stocktaking

Woolley & Wallis has extensive experience in the provision of valuation advice for financial statements and specialise in agricultural stocktaking. All our valuers are experienced Fellows of the Central Association of Agricultural Valuers (CAAV) which ensures our valuations are both accurate and credible if scrutinised by HMRC.

Expert witness

Woolley & Wallis regularly undertake expert witness reports and valuations to underpin financial disputes and/or claims for compensation. Our surveyors are acknowledged experts in their fields and have good working knowledge of litigation and court proceedings.

We can accept expert witness appointments on a wide range of valuation issues and are often instructed in connection with:

  • Matrimonial & partnership disputes
  • Negligence claims
  • Compulsory purchase claims
  • Taxation matters
  • Planning & development matters
  • Landlord & tenant matters

Our reports are prepared in accordance with Part 35 of the Civil Procedure Rules and the Royal Institution of Chartered Surveyors (RICS) Combined Practice Statements and Guidance Notes for Surveyors Acting as Expert Witnesses.

If you are not sure what type of valuation you require or have a specific requirement then please contact one of our local offices who will be able to assist you.

The Town & Country Planning System is often a key consideration in the sale, letting, use and development of land and buildings.

We specialise in planning and development matters encountered in both rural and urban areas and have a proven track record with applications for new development and regularisation of existing development.

As an established and reputable planning practice, we have developed strong working relationships with numerous other professionals upon whom we are able to call for advice on specialised matters such as architectural and structural design, highways, landscape and ecological impacts. We have also developed good working relationships with Local Planning Authorities with a reputation for well-constructed, accurate applications and submissions.

Our comprehensive service can be broadly divided into 2 distinct areas:

Planning & development control

Planning permission is normally required for the ‘development’ of land or buildings or the making of a material change in their use. Development is defined by the Town & Country Planning Act 1990 as ‘the carrying out of building, engineering, mining or other operations in, on, over or under land, or the making of any material change in the use of any buildings or other land'.

For certain forms or classes of development, planning permission is either not required or can be obtained by serving the appropriate notice on the Local Planning Authority (Prior Notification). These forms of development are known as ‘Permitted Development' and are set out by the Town and Country Planning (General Permitted Development) Order 1995 (as amended).

If you are unsure whether you need planning permission for a particular development, please feel free to contact Woolley & Wallis' Farm & Rural Department for a free initial consultation.

Our service also extends to development which might have been carried out without planning permission. We are able to prepare retrospective planning applications, apply for certificates of lawfulness, advise and deal with enforcement notices and appeals.

In practice, the procedure is instigated through the service of a Schedule of Dilapidations upon the tenant, towards the end of the lease. The schedule’s content will include the work a tenant needs to undertake to raise the condition of the property in accordance with the lease covenants. This works will cover repair, redecoration, reinstatement and statutory compliance, with the intention of leaving the premises in a condition suitable for re-letting.
